Terms of Service - BearCasual

1. Agreement to Terms

By downloading, installing, accessing, or using any BearCasual application (including but not limited to our iOS, Android, macOS, and Windows applications), you agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must immediately uninstall the application and cease all use of BearCasual services. Continued use indicates your acceptance of all terms herein.

These Terms of Service apply to all users globally and are governed by applicable laws including GDPR, CCPA, Apple App Store Guidelines, Google Play Store Policies, and all other relevant regional regulations.

2. Definitions

"Application(s)": All BearCasual software including iOS, Android, macOS, and Windows versions
"Services": All features and functionality provided through BearCasual applications
"User," "You," "Your": Any person downloading and using our applications
"BearCasual," "We," "Us," "Our": BearCasual development team and affiliated entities
"Intellectual Property": All designs, code, graphics, trademarks, and content owned by BearCasual
"Virtual Goods": In-app purchased items, virtual currency, premium features
"In-App Purchase (IAP)": Premium features or content purchased through Apple or Google stores
"In-App Advertisement (IAA)": Third-party advertisements displayed within our applications

3. Application Use & Restrictions

3.1 Permitted Use

You may download and install applications on your personal devices
Use is limited to personal, non-commercial purposes
You may use the application in accordance with all applicable laws
You acknowledge the application is licensed, not sold

3.2 Prohibited Activities

You agree NOT to:

Decompile, Disassemble, or Reverse Engineer: Attempt to extract source code or understand technical implementation
Crack or Bypass Licensing: Circumvent payment systems or license verification mechanisms
Exploit Vulnerabilities: Deliberately use bugs or security weaknesses for unauthorized benefits
Interfere with Services: Attempt to hack, deny service, or interfere with application functionality
Create Unauthorized Copies: Distribute applications without permission
Use for Commercial Purposes: Resell, lease, or rent without authorization
Automated Access: Use bots, scrapers, or automated tools to interact with the app
Data Theft: Attempt to extract other users' data
Illegal Content: Upload or use the application for illegal purposes
Harassment or Abuse: Use the application to harass, threaten, or defame others

3.3 Termination of Use

BearCasual reserves the right to terminate or suspend your access to the application if you violate these terms. Violations may result in permanent account suspension without refund.

4. In-App Purchases (IAP)

4.1 Payment Processing

iOS: All payments processed exclusively through Apple App Store
Android: All payments processed exclusively through Google Play Store
BearCasual never directly handles credit card information
Transactions are subject to platform provider terms

4.2 Virtual Goods & Licenses

Purchased virtual items are non-refundable except as required by law
Virtual currency and premium features have no real-world monetary value
Virtual goods are subject to change or removal with notice
License to virtual goods revokes upon account termination

4.3 Refund Policy

Standard Policy: All in-app purchases are final
Exceptions: Refunds granted only if legally required by:
- Apple App Store 14-day refund window (iOS)
- Google Play Store 48-hour refund window (Android)
Non-Compliance: Any unauthorized chargebacks will result in account termination
Request Process: Submit refund requests through the app store, not directly to BearCasual

4.4 Subscription Services

Subscription terms will be clearly displayed before purchase
Recurring billing continues until explicitly cancelled
Automatic renewal can be disabled in account settings
Cancellation instructions provided at time of purchase
No refunds for partial subscription periods

5. In-App Advertisements (IAA)

5.1 Ad Display & Third-Party Networks

BearCasual applications contain third-party advertisements
We do not endorse or control advertised content
Ad networks used: Google AdMob, AppLovin, Unity Ads, Facebook Audience Network, ironSource, and others
Third-party networks operate under their own privacy policies and terms

5.2 No Responsibility for Third-Party Content

BearCasual is not responsible for accuracy, legality, or appropriateness of advertisements
Clicking ads redirects to third-party websites beyond our control
Review third-party terms before engaging with advertised content
Report inappropriate ads through the app or to ad networks directly

5.3 Ad Types & User Experience

Banner Ads: Persistent ads at top or bottom of screen
Interstitial Ads: Full-screen ads between app screens
Rewarded Videos: User-initiated ads offering in-app benefits
Native Ads: Ads integrated into app content
Open Screen Ads: Full-screen ads on app launch

5.4 Ad Interaction Policies

Click-fraud or fake engagement is prohibited
Repeatedly clicking same ad may result in app suspension
Using tools to artificially inflate ad metrics is forbidden
We reserve right to modify ad frequency or placement

6. User-Generated Content & Data

6.1 User Content Ownership

You retain all ownership rights to data and content you create in BearCasual applications
We do not claim ownership of your personal data, notes, or records
You grant BearCasual a limited license to store and process your data locally

6.2 Data Storage & Responsibility

All user data stored 100% locally on your device
You are solely responsible for maintaining device security
BearCasual is not responsible for device loss or data loss due to device issues
Backup recommendations: Regularly export your data for safekeeping

6.3 Data Export & Portability

You may export all your data in standard formats (JSON, CSV, etc.)
Export functionality available directly within applications
Data remains yours even after account deletion

7. Intellectual Property Rights

7.1 BearCasual Ownership

All application code, design, graphics, and functionality owned by BearCasual
All trademarks, logos, and brand elements are protected intellectual property
You may not use BearCasual IP without express written permission
License is personal and non-transferable

7.2 Copyright Infringement

You agree not to use applications for copyright infringement
BearCasual respects intellectual property rights of others
We will respond to DMCA notices and legal takedown requests
Violations may result in account termination

7.3 Third-Party Content

Applications may contain third-party open-source components
Open-source licenses respected and disclosed
Third-party assets remain under original licenses

8. Limitation of Liability

8.1 Disclaimer of Warranties

BearCasual applications are provided "AS IS" without warranties of any kind. We make no representations regarding:

Accuracy, completeness, or reliability of application functionality
Fitness for particular purpose
Error-free operation or uninterrupted service
Compatibility with future OS versions

8.2 Limitation of Damages

In the maximum extent permitted by law, BearCasual is not liable for any:

Indirect Damages: Consequential, incidental, special, or punitive damages
Lost Profits: Loss of income or business opportunities
Data Loss: Corruption or loss of user data (except where prohibited by law)
Device Damage: Hardware issues or software conflicts on user's device
Service Interruptions: Downtime or unavailability of services

8.3 Maximum Liability Cap

Our total liability is limited to the amount you actually paid for the application or $100 USD, whichever is less. This limitation applies to all claims regardless of theory.

8.4 Essential Terms Exemption

These limitations do not apply where:

Prohibited by consumer protection laws
Gross negligence or willful misconduct involved
Death or personal injury involved
Local mandatory warranty laws apply

9. Privacy & Data Protection

Our Privacy Policy governs all data practices
Your use of BearCasual applications constitutes acceptance of Privacy Policy terms
Data handling complies with GDPR, CCPA, COPPA, and international regulations

10. App Store Compliance

10.1 Apple App Store Requirements

Applications comply with Apple Developer Program Agreement
App Privacy Label accurately discloses all data practices
App Tracking Transparency (ATT) implemented properly
IDFA usage complies with Apple guidelines
Content ratings accurate per IARC guidelines

10.2 Google Play Store Requirements

Applications comply with Google Play Developer Program Policies
Data Safety section complete and accurate
Sensitive permissions justified and documented
Content ratings appropriate per Google guidelines
Developer transparency requirements met

10.3 Platform Provider Terms

Your use also subject to Apple App Store Terms of Service (iOS)
Your use also subject to Google Play Store Terms of Service (Android)
Platform provider terms supersede these terms where conflicts exist

11. Acceptable Use Policy

You agree to use BearCasual applications only for lawful purposes:

No illegal activities, fraud, or deception
No harassment, abuse, threats, or discrimination
No sexual exploitation or CSAM materials
No violence incitement or dangerous activities
No malware, viruses, or harmful code distribution
No hate speech or discriminatory content
No unauthorized access to other users' data
No spamming or mass unsolicited communications

12. Account Termination

12.1 BearCasual's Right to Terminate

We may terminate or suspend your account and access immediately if:

You violate these Terms of Service
You violate applicable laws or regulations
You engage in prohibited activities
Your use poses security or legal risks
Fraudulent activity detected

12.2 Your Right to Terminate

You may delete your account at any time through app settings
Deletion is irreversible (except backups you've created)
No refunds issued upon account deletion
Some data retained for legal compliance periods

12.3 Post-Termination

No access to application or user data upon termination
Outstanding payments still due
Intellectual property restrictions continue to apply

13. Indemnification

You agree to indemnify and hold harmless BearCasual from any claims arising from:

Your violation of these Terms of Service
Your violation of applicable laws
Your infringement of third-party rights
Your use of the application for illegal purposes
Third-party claims related to your use

14. Modifications to Terms

We reserve the right to modify these terms at any time
Material changes will be notified through in-app announcements
Continued use constitutes acceptance of modified terms
Previous versions available upon request

15. Dispute Resolution

15.1 Informal Resolution

First attempt to resolve disputes through friendly negotiation
Contact support@BearCasual.com with dispute details
Response within 30 days with proposed resolution

15.2 Formal Dispute Resolution

Disputes resolved through binding arbitration where permitted by law
Arbitration conducted in English
Each party bears own costs unless arbitrator orders otherwise
Arbitrator's decision final and binding

15.3 Legal Jurisdiction

These terms governed by laws of Baoding, Hebei Province, China
Local mandatory consumer protections apply
Courts of competent jurisdiction may hear cases

16. Severability

If any provision of these terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary, or if impossible, severed. All other terms remain in full force and effect.
